Does the Beckham Regime Protect You from Wealth Tax, ITSGF and Modelo 720?

One of the most valuable (and often under-appreciated) features of Spain’s Beckham regime is not the 24% rate on employment income. It is the combination of limited wealth taxation and the absence of the foreign-asset reporting obligation that ordinary Spanish residents face.

This article explains exactly how the regime interacts with the Wealth Tax (Impuesto sobre el Patrimonio), the Temporary Solidarity Tax on Large Fortunes (ITSGF) and Modelo 720 in 2026.

The legal foundation: real obligation

Article 93.1 of the Spanish Personal Income Tax Act (LIRPF) states that a taxpayer who elects the special regime “shall be subject to the Wealth Tax by real obligation.”

Real obligation means the tax base is limited to assets and rights located in Spain (or that can be exercised in Spanish territory). Assets held abroad fall outside the Spanish wealth-tax base for the entire duration of the regime.

The same principle extends to the ITSGF. Binding rulings of the Directorate-General of Taxes (V0420-23 and V0424-23, both of 24 February 2023) confirm that impatriates under Article 93 are also subject to the Solidarity Tax by real obligation only.

Wealth Tax under the Beckham regime

While the regime applies, you are taxed only on Spanish-located assets. Typical examples that remain inside the base include:

  • Real estate in Spain
  • Spanish bank accounts and cash held in Spain
  • Shares in Spanish companies
  • Other rights that can be exercised in Spain

Assets that generally fall outside the base include:

  • Foreign real estate
  • Foreign bank accounts and investment portfolios
  • Shares in non-Spanish companies (subject to anti-avoidance rules on entities whose assets are predominantly Spanish real estate)
  • Foreign pension plans and life-insurance policies

You still benefit from the state €700,000 minimum exemption that applies to real-obligation taxpayers, and you may elect to apply the rules of the Autonomous Community in which the majority of your Spanish assets are located. This can be relevant in regions that maintain significant reductions or higher exemptions.

A return (Modelo 714) is still required if tax is payable or if the value of Spanish assets exceeds €2 million, even when the final tax is zero.

The Solidarity Tax (ITSGF)

The ITSGF is a complementary tax on net wealth above €3 million. Because its subject rules expressly refer to those of the Wealth Tax, the real-obligation treatment confirmed by the DGT applies equally.

In practice, for most Beckham taxpayers with limited Spanish assets, both the Wealth Tax and the ITSGF produce a zero or very low liability during the six years of the regime. The position changes abruptly once the regime ends and worldwide taxation resumes.

Modelo 720: no filing while the regime applies

The Spanish Tax Agency’s own frequently asked questions on Modelo 720 state that taxpayers under the special regime of Article 93 are not required to file the foreign-asset declaration. The reason is that the reporting obligation is linked to taxpayers who are taxed on their worldwide income — a situation that does not apply under the regime.

This exemption is personal to the individual who has elected the regime. A spouse or other family member who is an ordinary Spanish tax resident (and has not themselves elected the regime) may still be obliged to file if their foreign assets exceed the thresholds.

The exemption lasts for the full duration of the regime (the year in which tax residence is acquired plus the five following years). After the regime ends, if you remain a Spanish tax resident, the ordinary Modelo 720 obligation applies from the first 31 December that falls outside the regime. The first filing is then due by 31 March of the following year.

Modelo 721 (crypto assets held on foreign platforms) follows the same logic.

What happens when the regime ends

From the first tax year after the regime expires, the ordinary rules apply:

  • Wealth Tax and ITSGF on worldwide assets
  • Modelo 720 (and Modelo 721) if foreign assets exceed the thresholds
  • Ordinary IRPF on worldwide income

High-net-worth clients should model the transition at least 12–18 months before the regime ends. Options include restructuring the location of assets, considering a change of residence, or simply budgeting for the higher Spanish tax charge.

Common misconceptions

  • “I don’t pay any wealth tax at all under Beckham.” Incorrect. Spanish assets remain taxable.
  • “My spouse is automatically covered by my Modelo 720 exemption.” Incorrect. The exemption is personal.
  • “The relief continues indefinitely.” Incorrect. It is limited to the six-year window.
  • “I can ignore Spanish assets under €700,000.” A return may still be required if Spanish assets exceed €2 million.

FAQ

Does the Beckham regime eliminate Wealth Tax?
No. It limits the base to Spanish-located assets (real obligation).

Do I have to file Modelo 720 while under the regime?
No. The Tax Agency confirms that taxpayers under Article 93 are not required to file it.

Does the same protection apply to the Solidarity Tax?
Yes. The DGT has confirmed that the real-obligation treatment extends to the ITSGF.

When does the protection end?
At the end of the six-year period (year of becoming tax resident plus five years). Thereafter, ordinary worldwide rules apply if you remain a Spanish resident.

Can family members benefit?
Only if they themselves elect the regime and meet the conditions. Otherwise they remain subject to ordinary reporting and wealth-tax rules.
